Terms of use

This is a translation provided for convenience. The original Portuguese version is the only legally binding text, and it prevails if the two ever differ.
By installing and using Kart Coach you agree to what is written here. The text is short on purpose: if a rule needed a lawyer to be understood, it should not be in a kart app.
Safety comes before the app
Do not operate the device while the kart is moving. Set up the session while stopped, in the pits. The app was designed to be read at a glance, and even so, looking at the screen on track takes your attention away from where it needs to be.
Mounting the device on the steering wheel or on the kart is your responsibility, and you must make sure the mount withstands vibration and impact. A loose device inside a kart is a projectile, for you and for everyone on track.
Always follow the kart track's rules, the flags and the marshals' instructions. Many kart tracks forbid devices on board: if yours does, its rules outrank this app. Nothing Kart Coach shows authorizes driving beyond your limit, the kart's limit or the track's limit.
Headphones and the watch follow the same rule. Use headphones only if the kart track allows them, securely fitted and under a helmet that still closes properly, at a volume that lets you hear the track. Audio coaching and the watch's vibration are at-a-glance alerts: do not touch the watch or the device while the kart is moving.
What the app is, and what it is not
Kart Coach measures lap time, racing line, speed and G-force using the GPS and sensors of the iPhone itself. It is a training tool.
It is not official timing. A phone's GPS has a margin of error, and the times may differ from the kart track's timing. For race results, the kart track's transponder is what counts, always.
It is not a medical device either. Heart rate, calories and the workout saved in the Health app are estimates for personal tracking, and they are not meant for diagnosis or for making decisions about your health.
The app also does not replace safety equipment, kart maintenance or guidance from an instructor.
Development phase
Kart Coach is in development and distributed for testing. During this phase:
- features may change, be postponed or be removed;
- there may be defects that cause loss of session data;
- there is no guarantee of availability or of response time.
If your training data matters to you, do not rely on the app alone: also keep the kart track's printouts.
Your account
You are responsible for keeping access to your Apple ID. Losing access to it means losing access to the times linked to that account.
Do not use the app to send content that is illegal, offensive or not yours, and do not try to get around limits, access other drivers' data or automate requests in bulk. Use like that ends the account.
Content and conduct in leagues
In leagues, other drivers see what you write: nickname, number, team name and, if you are an admin, the league's name, description, links, seasons and rounds. That is why, before you join or create a league, the app asks you to agree to these rules.
Zero tolerance for offensive content, harassment and deception. Offensive, discriminatory, sexual or violent nicknames, names or text are not accepted; stalking, threatening or humiliating another driver is not accepted; and impersonating another person or another league, or publishing a false result, is not accepted.
- The app rejects known offensive terms when saving, but no list is complete. Any driver can report a driver, a team or a league with the "..." button next to it, and block a driver to stop seeing their nickname, number and times.
- Every report is reviewed within 24 hours.
- Content that breaks these rules is removed, and the account of whoever abuses them is closed, without prior notice when the abuse is serious.
- A league admin is also responsible for what the league publishes, and can remove from the league anyone who breaks these rules.

What is yours and what is ours
Your sessions, times and videos are yours. The app does not claim ownership of them and does not publish them anywhere unless you tell it to.
The Kart Coach name, icon, text and code belong to whoever made them, and may not be copied or redistributed without permission.
Price
The app is free during this phase. If there is ever a charge, it will be announced in advance and never applied retroactively to what you have already used.
Limitation of liability
The app is provided as is. To the extent permitted by law, we are not liable for damages arising from the use of the app or the inability to use it, including loss of session data, times that differ from official timing and damage to the device or the kart caused by an inadequate mount.
This does not remove the rights that Brazilian law guarantees you, including the Código de Defesa do Consumidor (Brazil's Consumer Protection Code).
Termination
You can stop using the app at any time, by deleting it and requesting deletion of your account through the means described in the privacy policy.
Governing law
These terms are governed by Brazilian law, and the competent court is the one of the consumer's place of residence.
